| $9.75 Million Minority Subcontracting Settlement |

On November 5, 2009, the U.S. Attorney's Office for the Eastern District of New York announced a $9.75 million settlement with Tutor Perini Corp. , a publicly traded construction services company, to settle civil claims of falsely reporting that it had subcontracted work on federally funded transportation projects to minority and disadvantaged business enterprises. The settlement resolved claims that the company had falsified documents reporting it was using certain minority and DBEs as subcontractors on New York city and state projects funded by the Transportation Department, when in fact non-DBE subcontractors were doing the work. The settlement was handled by the Federal Construction Fraud Task Force, which includes the criminal investigation division of the Internal Revenue Service, the NYC Department of Investigation, and the inspector general's offices of the federal Transportation and Labor departments, the Metropolitan Transportation Authority, and the Port Authority of New York and New Jersey.
